Free legal aid consists of providing legal advice, drafting submissions, representation, and defence. Providing legal advice is an explanation of the ways and possibilities of resolving a legal matter in court or in the process of peaceful dispute resolution. Drafting submissions involves creating written statements that initiate legal proceedings (such as a complaint, request, proposal, petition, appeal and objection). Representation is a legal act undertaken by an authorized lawyer on behalf of a user of free legal aid in court or in the case of peaceful dispute resolution. Defence is the representation of a suspect, accused, or convicted person who is being prosecuted for suspicion of having committed a criminal offence or misdemeanour. Often, citizens who have a problem do not know who to turn to and believe that obtaining legal assistance or advice from a lawyer is always too expensive. However, many users have the opportunity to receive free legal aid, which was established by law and has been applied since October 1, 2019. - Who is entitled to free legal aid?
- The law established three categories of citizens who have the right to free legal aid and a lawyer. In the first group are citizens who receive social assistance or child allowance, while in the second group are citizens with low incomes who are at the level of need for social assistance or child allowance, so they are not able to pay for a lawyer on their own. The third group of beneficiaries of free legal aid consists of vulnerable groups, including children, the disabled, victims of domestic violence, organized crime, asylum seekers, refugees and others.
- How is the right to free legal aid exercised?
- The request for the provision of free legal aid is submitted in the municipality, and on that occasion evidence of receiving social assistance, total assets and other evidence is also submitted. The lawyer decides whether there is a right to obtain free legal aid, then the applicant is referred to a lawyer from whom free legal aid is obtained or to the service of the local self-government. The deadline for a decision is eight days, while in urgent cases the deadline is up to three days.
